Estate Planning

Have you thought about your planning your estate? If not, it is never too late to start one.

At Calabrese Lawyers, we appreciate that estate planning involves more than just drafting a Will. There is much more involved to ensure that your assets are smoothly and efficiently distributed only amongst your chosen beneficiaries.

Having an estate plan makes certain that a level of security exists for your family and loved ones after your death. You can also stipulate exactly what each beneficiary is to receive.

We endeavour to provide you the right advice in plain language and lay down your estate options from the beginning.

We will guide you in all areas of your estate planning including:

  • Will – It is tremendously important that you have a valid Will. Having a valid Will gives you the power to distribute your assets to whom and what manner you wish. If upon your death you do no have a valid Will, your estate will be distributed according to the intestacy laws. This means that your estate may be handled by someone you did not want to and your assets may be distributed to those you did not intend to give to. If you already have a Will, it may be time to review your Will as your circumstances may change and your Will no longer fulfils your testamentary wishes.
  • Power of Attorney & Enduring Guardianship - Having a Power of Attorney and an Enduring Guardianship is also important, especially in the event that you loose the capacity to make your own decisions. A Power of Attorney allows you to legally nominate a person to act on your behalf in relation to legal decisions whilst an Enduring Guardianship relates to health and lifestyle decisions.
  • Probate – We understand that it is an extremely difficult time when a loved one passes away. Calabrese Lawyers can assist in obtaining probate and guide you through the steps to administer the estate according to the terms of the will.
